 note = {窮民救助法案法は、第1回帝国議会に、政府提案の第1号法案として提出されたものである。しかし、残念にも衆議院で否決された。本論文は、同法案の否決の背景を、帝国議会議事速記録を詳細に検討すること、及び明治期の地域構造を分析することを通して、明らかにすることを目的とする。
政府は、窮民救済事務を市町村の「義務」に含め、自治体としての市町村を強固なものにしようとしたと思われる。
法案審査委員会の9人の委員は２つのグループに分かれた。一方は、法案の修正を求め、他方は廃棄を要求した。衆議院の本会議では、最終的に、同法案の審議の不継続を決定した。
修正案と廃棄案の違いは少なく、違いは，現行救済法を不完全と見るか否か、また、種々の現行法を一本化する等のために法律を必要とするか否かという点に過ぎなかった。両案は、共通して、救済対象を「災厄遭遇者」に拡大することや、それまでの地方の救済方法や慈善者に国が干渉することに反対した。つまり、両案には共通点が多くあったのである。
反対の背景には、衆議院議員に地主階層の者が多く、また、合併前の町村の指導的立場にあり、そのため、自分たちの財政負担の増大や、町村に合併された地域間の不均衡の拡大に懸念を持つものが多かったことによると思われる。, The Poor Relief Bill of 1890 was the first bill submitted by the government to the first Diet. However the bill was regrettably voted down in The House of Representative. This paper aims to clarify the context of that rejection through investigating the proceedings of the Diet and analyzing the regional structure in the Meiji era.
The government would oblige relief work to be the responsibility of local government for making it more autonomous.
Nine members of the deliberative council divided into two groups, one required alteration, the other demanded rejection. Plenary meeting of The House of Representative ultimately passed a vote of discontinuing the deliberation of the bill.
There was a little distinction between both groups: whether resuming the existing remedy deficient or not, and recognizing the necessity of a new law to integrate the existing remedy or not. Both groups mutually opposed helping sufferer in plague or danger, and being interfered in the way of own relief and charities by the government. That is, both groups had a lot of commonality.
A lot of member of The House of Representative had belonged in the propertied class, and they had played a leading role in the community before the synoecism on 1889. Accordingly, they had feared about increasing burden of themselves, and had felt uneasy about widening of interregional disequilibrium.},
