| 内容記述 | In September 2020, a lawsuit for state compensation for psychiatric treatment was filed. The plaintiff is patient with mental illnesses who have been hospitalized for a cumulative total of 44 years, and this is the first lawsuit in Japan to challenge the history and state of mental healthcare policy with the government as the defendant. The complaint alleges that the current Mental Health and Welfare Law is unconstitutional as well as the long-standing mental healthcare policy, and holds the Ministry of Health, Labor, and Welfare and the Diet responsible for their inaction. The defendant national government denies the plaintiffs' allegations and has responded with a full-fledged fight, asking the court to dismiss the lawsuit. This article will summarize the problems with psychiatric care in this country by introducing the Study Group for Litigation of State Claims for Psychiatric Compensation, which has been preparing for the lawsuit, and the plaintiff patient, and by describing the progress report of the ongoing lawsuit. |

| 内容記述 | 2020 年9 月、精神医療国家賠償請求訴訟が提訴された。累計入院期間約44 年 に及ぶ精神疾患をもつ患者が原告となり、国を被告として精神医療政策の歴史とあり方を 問う本邦初の裁判となる。訴状では、長年にわたる精神医療政策と現行の精神保健福祉法 が違憲状態にあることを訴えるとともに、厚生労働省と国会の不作為責任を問うている。 被告国側は原告の主張を否認し、訴えを退けるよう裁判所に求めて全面的に争う姿勢で反 論をしている。本稿では、訴訟を準備してきた精神医療国家賠償請求訴訟研究会の概要と 原告患者を紹介するとともに、現在進行中の裁判の途中経過報告を記すことで、この国の 精神医療の問題点を整理する。 |
